Through out This site I will explain many things related to a man named Mr. Phillip Alvin Jones, My husband. He is incarcerated in a Washington State Prison. He has been locked up for almost 18 years, and is innocent. I will walk you through his case an point out the facts that proves he is innocent. As well as walk you through the many attempts to try an find some kind of Legal help. Our attempts have been unsuccessful. I will also come and update as we go.
Why is This site up?

*Key Facts about the case
-Phillip was arrested on September 16, 1990
-The shooting happened on August 20, 1990
-Phillip was 19yrs old
-The incident took place on the corner of Fayette and Mount St. in west Baltimore, Maryland
-There was no gun recovered
-There were no Finger Prints
-There was no Motive established for the shooting
-There was only one state eyewitness "Gin Gin"
-She perjured herself before the Grand Jury
-She was a drug addict, with a criminal history
-She didn't report the shooting, nor did she come forth. The police were told about her by another drug addict (informer) who was arrested for a burglary and needed away out of going to jail. He told them that he didn't see the shooting, but he knew someone who did; and he gave them "Gin Gin's name.
-Gin Gin, passed away of AIDs years ago.
-The victim said, he never saw who shot him
-Phillip and his co-defendant were arrested on nothing but the word of a drug addict witness
-The newly found evidence we have is the testimony and sworn affidavit of the victims cousin Jerome (non bias witness), who says he was directly across the street from his cousin when the shots were fired. He says that Gin Gin, could not have seen anything from where she was supposedly standing. He was not able to see who the shooter was let alone anyone else.
- It was about 11:30pm and raining,
-The shooter had on black full length rain coat with a hood on.
-Phillip was offered a 7year plea agreement which He turned down, because he didn't do the crime.
-The reason it has taken this long to come up with this evidence is because we didn't know about the cousin until recently.
-The states attorney withheld this exculpatory evidence from us during the discovery phase
As you can see right here, we have all the key facts to prove my husbands innocence, now we just need your help.
in the next pages I have typed up the letters my husband has wrote in our efforts to get legal help. As well as the people we have wrote.
This is why I am left with the only resort to start a Legal Defense Web site to get my husband home. Praying someone will see his case and help us!

In Re: to The Post conviction Hearing...
The matters in this case remained undecided for one day more than 20 months. At that time, on October 29, 2007, the Circuit Court neither granted nor denied the pending motion to dismiss the petition that had been the subject and focus of the prior proceedings in the case. Rather, the Circuit Court denied relief, determining in its Memorandum and Opinion that “[o]n February 28, 2006, a hearing on the second Petition for Post Conviction was held before the undersigned judge.”
This application for leave to appeal that decision of October 29, 2007, is timely submitted.

APPLICATION FOR LEAVE TO APPEAL
Applicant Phillip Alvin Jones, also known as Alvin Jones, Jr., by and through the undersigned attorney, hereby applies, in accordance with Maryland Rules 4-408 and 8-204, for leave to appeal to the Maryland Court of Appeals the denial of his Second Petition for Post-Conviction Relief from his conviction for attempted first-degree murder, attempted second-degree murder, conspiracy to commit first degree murder, and use of a handgun in the commission of a crime of violence and his sentence amounting to two concurrent life sentences and two 20-year sentences to be served concurrently with one another but consecutive to the two life sentences. The underlying post-conviction proceeding was resolved within the proceeding styled Alvin Jones Jr. v. State of Maryland, in the Circuit Court for Baltimore City, in a decision made by the Honorable Lynn K. Stewart, Circuit Judge, on October 29, 2007. A true copy of that decision is appended hereto as Exhibit 1. Applicant Jones was, at the time of the proceedings in the Circuit Court, and still is, confined under the jurisdiction of the State of Maryland within a facility located within the State of Washington.
Parole Related
February 2008
So Phillip is up for his parole hearing... We have wrote to the Maryland parole commission, We have a job lined up and he has pretty good references from some of the staff at WSP. I'm hoping that between my letter and his job. They will see that its time for him to come home.
